In the wake of the tragic 2017 Grenfell Tower fire in London, the New South Wales government implemented significant reforms aimed at improving fire safety within residential strata buildings. These changes were designed to ensure the safety of all residents and reduce the risks of fire-related disasters in high-rise buildings. As building owners and strata managers, it is essential to understand these regulations, how they affect you, and what steps you need to take to comply.

One of the most significant changes is the introduction of mandatory annual fire safety assessments for all strata buildings. These assessments are now a legal requirement under the Environmental Planning and Assessment Regulation 2021. The role of a fire safety assessor is crucial, as they will examine the building’s fire safety systems, ensuring they meet the minimum performance standards. This includes checking everything from fire alarms to evacuation routes and ensuring that the building’s fire systems are up to code.

The fire safety assessor will review the building’s fire safety system installation diagrams, baseline data, engineering reports, and evacuation plans. They will ensure that evacuation paths are clear of obstructions, properly lit, and well-signed to help residents evacuate quickly in the event of an emergency. Assessors will also evaluate the performance of fire systems to make sure they meet the required standards.

Importantly, not all fire safety assessors are qualified to assess every type of fire safety measure. There are 36 different fire safety measures that could be installed in a building, and assessors may only be qualified to sign off on some of them. To comply with the regulations, it is essential to choose an assessor who is qualified to assess all the fire safety measures installed in your building.

Building owners are now legally required to maintain fire safety systems in accordance with Australian Standard 1851, which will be enforced from February 2025. This maintenance standard outlines the procedures for regularly checking and servicing fire safety equipment. Failure to comply with Australian Standard 1851 could result in significant fines—up to $66,000 for corporations and $33,000 for individuals for each breach.

To avoid these penalties and ensure your building is safe, it is crucial to select a fire safety company with the qualifications and experience to guide you through the new regulations and maintain your systems in compliance with the law.

The new regulations place greater responsibility on building owners to ensure their fire safety systems are in top condition. It is recommended that building owners have any faults identified during monthly or biannual inspections repaired early, to avoid larger repair costs and potential delays in submitting the annual fire safety statement.

Make sure that all necessary documents—such as building plans, installed diagrams, baseline data, equipment schedules, and asset registers—are available at the time of the annual inspection. This will help streamline the process and ensure that your fire safety systems are thoroughly evaluated and certified.
